Cassation appeal
Cassation proceedings are very different from proceedings before a district court or a court of appeals. In the case of cassation, the case is no longer heard in its entirety, and in most cases there is no hearing that you can attend. The Supreme Court only assesses whether the earlier judgment meets the requirements set forth in the law and whether it was properly and sufficiently reasoned. If it does not, the Supreme Court will set aside the earlier judgment and - as a rule - refer it back to the trial court, where the case must be retried in its entirety.
