Manslaughter is described in the Dutch Penal Code as intentionally taking another person's life. As such, manslaughter is similar to murder. The difference between the two crimes is that murder also requires premeditation. Thus, if a suspect acts intentionally but from a whim, it is called manslaughter; if a suspect acts from a premeditated plan, it is more likely to be murder.

Attempted manslaughter

Attempted manslaughter is also punishable. One speaks of an "attempt to" when the intention of the perpetrator has revealed itself through a beginning of execution. If someone survives a stabbing or shooting, it will soon be considered attempted manslaughter. This is less evident in the case of (violent) fights. With some regularity, the public prosecutor in such cases has several anchors: the primary charge is then attempted manslaughter, the secondary charge is (attempted) aggravated assault and the secondary charge is simple assault. If you are suspected of attempted manslaughter, this does not mean that you will immediately face a severe punishment.   • Manslaughter is punishable under Article 287 of the Dutch Penal Code. This article reads:

    "He who intentionally deprives another of life shall be punished, as guilty of manslaughter, by imprisonment for a term not exceeding twenty-five years or a fine of the fifth category."

  • In each individual case, a judge must assess what punishment he deems appropriate and necessary if he reaches a conviction. Therefore, a standard punishment for manslaughter does not exist.

    However, the law does have maximum penalties. For manslaughter (without aggravating circumstances) it is a prison sentence of up to 25 years or a fifth category fine.
