Murder is described in the Dutch Penal Code as taking another person's life "intentionally" and "with premeditation.
The latter distinguishes murder from manslaughter. Manslaughter is also defined as intentionally taking another person's life, but does not require that it be premeditated. Homicide, of course, is also a serious crime, but has a lower penalty maximum than murder.

Murder is punishable under Article 289 of the Dutch Penal Code. This article reads:
"He who intentionally and premeditatedly deprives another of his life shall be punished, as guilty of murder, by life imprisonment or temporary imprisonment for a term not exceeding thirty years or a fifth category fine."

Murder is distinguished from manslaughter with the requirement that the perpetrator took another person's life "with premeditation. Premeditation refers to a moment of calm deliberation, of calm thought prior to execution. It is the opposite of killing another on a whim.
Case law has elaborated on the concept of premeditation. It must be established that the accused had an opportunity to consider the decision to be made or the decision taken for some time and that he did not act on an instantaneous whim. If that opportunity existed, it is an important indication that the defendant acted with premeditation. -
The maximum penalty for murder is life imprisonment. Whether that is actually imposed is a second thing. The judge will always have to determine, in each individual case, what punishment he deems appropriate and necessary.
